In July 2008, the Council of Australia Governments (CoAG) formally committed to the harmonisation of work health and safety laws based on a national model. The model Work Health and Safety (WHS) legislation consists of an integrated package of a model Work Health and Safety (WHS) Act, supported by model Work Health and Safety (WHS) Regulations, model Codes of Practice and a National Compliance and Enforcement Policy. To date, new work health and safety laws have been enacted in New South Wales, Queensland, the Australian Capital Territory, the Commonwealth and the Northern Territory, coming into force on 1 January 2012. The other states have committed to enact similar laws. When the harmonised laws are in place across Australia, compliance with work health and safety responsibilities will be largely the same across all states and territories. The new laws have implications for sporting bodies at all levels, in particular since they include provisions for volunteers.See below:

Volunteers and the Model Work Health & Safety Safe Work Australia is the national body responsible for the development and evaluation of the model WHS laws. The ASC is working with Safe Work Australia with the aim of providing specific advice to the sport sector on the laws. It is our intent to get a position on how the laws specifically impact on sports at different levels and what sporting organisations need to do in response. In the interim should you have any concerns you are facing right now and you cannot get any traction or advice to resolve the concern then please advise us so we can facilitate. While this work is progressing, Safe Work Australia, in association with Volunteering Australia, has developed a suite of fact sheets and FAQ’s directly targeting the volunteer sector (attached), which provide guidance.
